Z&C CREATIONS – extract from General Terms and Conditions

1. Who we are

Z&C CREATIONS is the business name of:

2. What these terms apply to

These General Terms and Conditions (“GTC”) govern, in accordance with Section 1751(1) of the Czech Civil Code, the mutual rights and obligations between Z&C CREATIONS as the seller and you as the customer (consumer or entrepreneur) when entering into a purchase contract for goods and custom-made work, in particular fursuits and related accessories.

We usually conclude contracts remotely via e-mail, and in some cases in person at a sales stall or in another form expressly agreed between the parties. For sales at a stall, the purchase contract is concluded at the moment when the goods are taken over and the price is paid.

3. How we communicate and what takes precedence

• We communicate with you primarily by distance means, in particular by e-mail, and where applicable via other agreed channels (for example, Telegram).
• If we and you expressly agree on any terms that differ from these GTC (for example in the purchase contract or in an Amendment to the GTC), that individual agreement takes precedence over these GTC.

4. Key terms (simplified)

• Price – the amount you pay for the goods.
• Delivery Price – the amount you pay for delivery of the goods, including packaging.
• Total Price – the sum of the Price and the Delivery Price.
• Invoice – an accounting document issued for the Total Price of the agreed goods or services. Z&C CREATIONS is not registered for value added tax (VAT), therefore the Invoice is not a tax document under Czech VAT law and does not state any VAT amount.
• Pro forma Invoice – a document by which we ask you to pay a Deposit; it serves only as a payment request and is not in itself an accounting or tax document.
• Deposit – a part of the Price paid in advance, before or during production, which is set off against the Total Price under the final Invoice.
• Interim Payment – a further payment on top of the Deposit already paid, typically after a certain stage of the commission has been completed, but before the final Invoice is issued.
• Balance Payment – the final remaining part of the Price after deduction of all Deposits and Interim Payments, included in the final Invoice, usually payable on handover or before dispatch.
• Order – your binding offer to enter into a purchase contract with us for specific goods.
• Customer / Buyer / you – a natural person or legal entity that concludes a contract with us; in these GTC and this extract, “Customer” and “Buyer” are used synonymously.
• Goods / Product – anything we are able to offer you in our non-binding communication (for example ready-made products, custom-made costumes, accessories).
• E-mail Communication – communication between you and us using the e-mail address stated above.
• Subject Line – the text field in the e-mail indicating what the communication is about.
• Amendment to the GTC – a document setting out individual terms agreed by both parties that go beyond or deviate from these GTC; once approved by both parties, it forms an integral part of the purchase contract.

5. Commissions, capacity and availability

• When we open commission slots for new orders (for example for custom fursuits), this opportunity is announced on the website www.zccreations.cz.
• If we receive more Orders than we have available slots in the commission queue, Z&C CREATIONS reserves the right to select those Orders that are suitable for production and realistically within our capabilities.
• You will be informed by e-mail whether your Order has been accepted or rejected.
• Information on the maximum number of available commission slots will be provided on request via the contact e-mail stated in the GTC.
• Provisions relating to the future online shop (availability of ready-made goods, maximum quantity per Order) will only apply from the date on which information about its launch is published on the website.

6. Production environment and allergens

Z&C CREATIONS products are made in a home environment in which a cat is present. Although we make every effort to prevent any contact of the animal with the products and materials, the presence of trace allergens (such as animal hair) cannot be completely ruled out. If you suffer from significant allergies, please take this into account before placing an Order.

7. Photographs, “secret project” and non-publication

The Customer agrees that photographs of the finished Product (for example a costume) may be used to present the work of Z&C CREATIONS, in particular on social media, on the website or in our portfolio. If the Customer does not agree, they must expressly inform us when confirming the Order.

• If the Customer requires a so-called “secret project”, Z&C CREATIONS undertakes not to publish, before handover of the commission, any photographs from which the overall final appearance of the Product could be clearly inferred. However, we may use detailed, partial or otherwise edited shots in which the final appearance is not recognisable.
• Where the Customer requires absolute non-publication of photographs of the Product and its creation (i.e. a ban on use for the portfolio, the website, social media and any other forms of presentation), this must be expressly stated when confirming the Order. This fact and the Customer’s request will also be expressly stated in the purchase contract or in a written Amendment to the GTC, which forms an integral part of the purchase contract.
• In such a case, Z&C CREATIONS is entitled to include in the Total Price additional costs incurred due to the impossibility of including the Product in its portfolio and marketing presentation. The amount of such additional costs will be communicated to the Customer before binding confirmation of the Order; without the Customer’s approval, the Order will not be accepted.
• The arrangements regarding a “secret project” or absolute non-publication of photographs may be further specified between the parties in an Amendment to the GTC, which forms an integral part of the purchase contract.

8. Important summary

• Z&C CREATIONS is not registered for VAT. Prices are final and no VAT is added.
• For custom-made products created to your specifications (for example individually designed costumes or reference sheets), you generally cannot withdraw from the contract without giving a reason once the Order has been confirmed and production has begun, in accordance with Section 1837 of the Czech Civil Code.
